Granny Flats One Step Closer

A major change to the way New Zealanders can build granny flats is on the horizon, as the Building and Construction (Small Standalone Dwellings) Bill has officially passed its first reading in Parliament.

The Bill proposes to remove the need for building consent for granny flats up to 70 square metres—provided they follow a simple design, comply with the Building Code, and are constructed by authorised building professionals.

This consent exemption aims to streamline the building process and unlock new housing potential, with an estimated 13,000 additional granny flats expected to be built over the next decade.

What You Need to Know

Under the proposed changes, you would still need to notify your local council before beginning construction and once the granny flat is completed. While building consent may not be required, fees to help support infrastructure like water, sewerage, and transport—will still apply. These will be charged when councils issue a Project Information Memorandum (PIM).

It's important to note the law has not changed yet. That means if you're planning to build a granny flat now, you will still need a building consent until the new legislation comes into effect.
